Duties Description Under the general supervision of the agency’s General Counsel, the Associate Attorney’s responsibilities will include, but are not limited to:

• Providing legal advice/information to the Director, General Counsel, and other staff.
• For continuity of operations, serving as Counsel should General Counsel be unavailable.
• Reviewing and hearing administrative appeals:
o Managing all aspects of the appeals process, which includes triaging requests, scheduling and conducting hearings, and issuing final appeal decisions.
o Hearing and determining decisions on appeal.
• Providing education/outreach and being agency point of contact to outside agencies, victims of crime, and providers, as assigned.
• Conducting legislative and regulatory analysis.
• Reviewing the accuracy of updated educational and informational materials.
• Providing legal review of complex/first impression questions from agency staff on matters related to the transfer, storage, and maintenance of associated Sexual Offense Evidence Collection Kit (SOECK) materials stored by OVS.
• Providing legal review of complex/first impression Compensation Unit investigations.
• Directly supervising the agency’s Senior Attorney and Legal Assistant II, including the preparing of annual performance reviews.
o Supervision and oversight of Senior Attorney’s duties, including:
• The State’s enforcement of the “Son of Sam” law [Exec law, §632-a].
• Response to civil legal actions brought against the agency [CPLR, Art. 78].
• Working with OVS’ Administrative Services and Grants Unit staff for items such as responding to legal questions and drafting of MOU/MOAs.
• Liaising with the NYS Archives and purging legal documents related to the “Son of Sam” law.
o Supervision and oversight of Legal Assistant’s duties, including:
• Performing complex paralegal duties related to topics including, but not limited to restitution, subrogation, and collection files.
• Preparing legal documents such as Notice and Satisfaction of Liens, Affidavits, Certifications, Waivers of Citation and Consent, Answer and Objection, Orders to Show Cause and Lien Waiver Application Recommendations in accordance with legal timeframes.
• Ensuring proper and timely filing of the Office’s Notice of Lien with the appropriate County Clerk’s Office. Responding to inquiries regarding the Notice of Lien.
• Managing related bill tracking activities through the Legislative Retrieval System.

Minimum Qualifications Permanent service in this title or one year of permanent service in a title SG-26 or higher, and otherwise eligible for transfer under Civil Service Law. Candidates on the Associate Attorney promotion list will be canvassed and need not respond to this posting.

Provisional: One year of permanent-competitive or 55B/C service as a Senior Attorney SG-25. If appointed provisionally, you must take and pass the next exam for this position and be reachable on the resulting eligible list.

A permanent appointment pursuant to Section 52.7 of Civil Service Law may be possible if there are three or fewer current OVS employees meeting the above provisional qualifications that are interested in this position

Candidate must also be admitted to the New York State Bar and have current registration to practice law in New York State.

Additional Comments Up to 10% travel may be required. Some positions may require travel to locations not serviced by public transportation.
