Duties Description Under the general direction of the Deputy Counsel for Medicaid, Contracts, Real Estate, and Trusts & Estates (MCRE), the candidate would primarily assist OPWDD's Contract Management Unit (CMU) with legal issues relating to procurement of state contracts.

Primary duties:
•Assist CMU in responding to legal issues arising out of its preparation and review of solicitations, procurement instruments, contracts, and contract amendments; identifying and responding to vendor responsibility issues; negotiating and reviewing contract terms and conditions.

•Review and analyze issues raised in bid protests and appeals of agency level bid protest determinations. Prepare bid protest determinations.

•Provide counsel and guidance related to contracts and purchasing, including real estate and construction; information technology; transactional matters; grants; and memoranda of understanding among state entities.

•Review, analyze, draft, and, as appropriate, negotiate a broad variety of procurement solicitations, contracts, and licenses.

•Provide Counsel's Office and OPWDD program staff with support and opinions on transactional issues.

•Provide additional support to the MCRE unit related to transfers of state property and other real property related matters, including issues arising from OPWDD and DASNY's real property portfolio, OPWDD's supportive housing grants, and the property cost reimbursement process.

•Provide additional support to the MCRE unit on Medicaid-related issues, including Medicaid audit and wage and hour issues.

Provide general legal support to Counsel's Office and agency staff:
•Conduct legal research of statutes, regulations, decisions, opinions, and other legal sources to respond, both orally and in writing, to requests for legal opinions.

•Conduct legal research and analysis; prepare written memoranda, correspondence, and verbal opinions of Counsel, as needed. •Provide presentations to OPWDD program staff, Counsel, and staff from other agencies or the Executive on relevant legal issues related to OPWDD operations.

•Review and provide comments on proposed and enacted legislation, and court decisions, that impact OPWDD operations.

•A strong ability to analyze and interpret statutes and caselaw is also needed.

Minimum Qualifications Preferred Qualifications:
Candidates must have been admitted to the New York State Bar and must have had two years of experience in the practice of law subsequent to admission to the Bar.
